Spirit Halloween Sued by Business Claiming Franchise Law Breach

Spirit Halloween Superstores LLC has been sued by a California business claiming the costume and décor retailer’s decision to end their quarter-century relationship violated California’s Franchise Relations Act.

The plaintiffs, D’s Gone Batty, Inc. and its principals, Damara Arsanis, and Dax Arsanis allege that their 25-year relationship with Spirit Halloween constituted a franchise under the act, though Spirit officially treated their outlet as a consignment arrangement.

They operated seasonal Spirit Halloween stores under Spirit’s marketing plan, were granted a license to use Spirit’s trademarks, and paid fees including deposits and markups to Spirit, according to their complaint filed Jan. 23 ...
