Spirit Airlines Beats Wiretap Suit Over Session-Replay Software

Spirit Airlines Inc. defeated a proposed class action alleging it recorded consumers’ interactions and communications with its website in violation of state wiretap and privacy laws.

Plaintiffs Malinda Smidga, Frances Curd, and Kayla Mandeng failed to allege that they suffered concrete injuries sufficient for Article III standing, Judge Marilyn J. Horan of the US District Court for the Western District of Pennsylvania said April 5.

Horan dismissed the lawsuit for lack of jurisdiction, but gave the plaintiffs until April 19 to file an amended complaint.
