Spire, Gas Groups Again Lose Bid to Undo Boiler Efficiency Rule

The Department of Energy’s final boiler efficiency rule will stay in place, the D.C. Circuit said Wednesday in another loss for Spire Inc., Spire Missouri, and industry associations that argued the department failed to take appropriate action following the court’s remand.

The US Court of Appeals for the D.C. Circuit wasn’t persuaded that the agency’s rule was supported by “clear and convincing evidence” that it was “economically justified, technically feasible, and will lead to significant conservation of energy,” the panel said in January.
