La Sierra University failed to shake off negligence claims by a spectator struck in the face by a foul ball while attending a college baseball game.

Monica Mayes may proceed with her suit because there is a triable issue of whether the university had a duty to install netting over its dugouts to minimize the risk of spectators being hit by batted balls, a California appeals court said Jan. 7.
