Southwest Pilot Union Can Proceed With Boeing 737 Max Wage Suit

Boeing Co. will have to face a lawsuit filed by the Southwest Airlines Pilots Association representing members who allegedly lost millions of dollars in compensation when the airline canceled or reduced flights because of the grounding of 737 Max airplanes.

SWAPA filed two suits, one in 2019 and one in 2021. SWAPA sued on behalf of its members and itself in the first suit, but the Texas Court of Appeals, Fifth District, ruled in March that it lacked associational standing and that post-petition assignments couldn’t cure the defect because jurisdiction is determined at the time the suit is filed.
