Southern Comfort Whiskey Buyers Get Class Status in False-Ad Row

Consumers alleging Sazerac Co. deceptively marketed miniature bottles of Southern Comfort-branded whiskey can proceed with their lawsuit as a class, a federal judge said Thursday.

The consumers alleged the smaller bottles trick buyers into thinking they are getting whiskey when really the bottle contains a malt beverage with “whiskey flavor.” The US District Court for the Southern District of New York granted the consumers’ class certification motion, but said only one of the named plaintiffs could proceed as the class representative.

Sazerac is facing similar lawsuits over its mini Fireball bottles and Chi-Chi’s Margarita products.
