Southern Coal Corp. Appeals $2.5 Million Water Pollution Penalty

Southern Coal Corp. and Premium Coal Co. want the Fourth Circuit to weigh in on whether they must pay about $2.5 million for alleged violations of a water pollution agreement with the federal government, according to a filing in the appeals court.

The federal government, Alabama, Kentucky, Tennessee, and Virginia sued Southern Coal and other companies for violating the Clean Water Act and similar state laws. The complaint alleged a violation of National Pollutant Discharge Elimination System permits issued to the companies, and a failure to respond to the government’s requests for information.
