Abortions after the sixth week of pregnancy are allowed in South Carolina for now, as the state’s top court Wednesday temporarily blocked enforcement of a ban pending a decision on its validity under the state constitution.
Planned Parenthood South Atlantic, Greenville Women’s Clinic, and two doctors sued in July, arguing that the six-week ban violates the South Carolina Constitution’s provisions for privacy, equal protection, and due process. A trial court judge allowed the ban to stand, but sent the case to the state supreme court.
