South Carolina Patients Denied Suit Against Records Suppliers

Information management companies escaped a proposed class action alleging that they overcharged South Carolina patients who requested medical records the firms supplied on behalf of their doctors.

A South Carolina law that caps the fees that patients may be charged for their medical records applies only to physicians and “owners” of the records, not to third-party medical records companies, the US Court of Appeals for the Fourth Circuit said Friday in affirming the case’s dismissal.
