Solar Company’s Trade Secret Suit Against General Counsel OK’d

Onyx Renewable Partners LP can proceed with claims that the solar energy company’s former general counsel misappropriated trade secrets when he and his wife left the company, a federal court ruled.

The company sufficiently alleges that Hilary Kao violated the Defend Trade Secrets Act by surreptitiously downloading and transferring to his personal devices over 10,000 of Onyx’s confidential, privileged, and proprietary documents before he left the company, Judge Ronnie Abrams of the US District Court for the Southern District of New York ruled Wednesday.

The court rejected Kao’s argument that Onyx fails to specify the trade secrets allegedly misappropriated.
