Social Work Board Beats Suit Alleging Biased Certification Exam

Three Black and Hispanic social workers lost another bid to advance their suit against the Association of Social Work Boards, alleging its certification examinations are racially biased and hinder their abilities to enter the profession.

The social workers’ proposed class action, alleging violations of Title VII, Section 1981, and the New York State Human Rights Law, can’t survive the association’s motion to dismiss, since they failed to establish an employer-employee relationship with ASWB or plead intentional discrimination, Judge Kenneth M. Karas said Thursday, granting ASWB’s dismissal motion with prejudice.
