Virtika Outerwear founder David Lesh won an appeal undoing his conviction for performing “unauthorized work activity” on National Forest System lands, with the Tenth Circuit saying the regulation failed to warn social media users that posting images on the internet could constitute a federal crime.
There was also insufficient evidence to prove that Lesh posted the images with the primary purpose of exchanging goods or services, the US Court of Appeals for the Tenth Circuit said in the Tuesday decision.
