Snyder’s-Lance Drivers Keep Collective Status, Advance Wage Suit

More than 300 delivery drivers may continue to proceed as a group in their Fair Labor Standards Act overtime suit against the distribution arm of snack food maker Snyder’s-Lance after a federal judge in North Carolina rejected the company’s bid to decertify the collective.

The drivers contracted with S-L Distribution Co. under nearly identical agreements to deliver Snyder’s-Lance products to retailers along a designated customer route.

The evidence shows that the drivers were subjected to a similar level of supervision over their work, had similar opportunities for profit and loss, possessed similar skill sets, made similar financial investments in their ...
