Smoothstack Employee Partially Drops Wage and Hour Contract Suit

An employee of technology staffing company Smoothstack Inc. agreed to drop three claims from his wage and hour lawsuit.

Smoothstack agreed on Tuesday to waive the 4,000-hour training requirement for employee Justin O’Brien, who in return agreed to dismiss claims under Virginia law and his federal claim regarding unlawful wage clawbacks. O’Brien had alleged in the US District Court for the Eastern District of Virginia that Smoothstack’s training repayment agreement violates the Fair Labor Standards Act and effectively lowers compensation to “well below minimum wage.”
