A group of North Carolina residents’ claims that a Smithfield Foods Inc. subsidiary’s large scale hog farm is allowing animal waste to spread beyond the property’s perimeter can proceed, a federal district court decided.
Circle K II Inc. raises more than 20,000 swine at a concentrated animal feeding operation in Duplin County under an agreement with Smithfield subsidiary Murphy-Brown Holdings LLC. Several nearby residents who allege the operation allows animal waste to reach their properties have adequately alleged claims of trespass and negligence, the U.S. District Court for the Eastern District of North Carolina said in a Monday order.
