Smith & Wesson Inc. must face several claims of a proposed class action alleging the gun manufacturer used online tracking tools to collect consumers’ personal data even after they had opted out of the use of the tools during their website visits.
Lead plaintiffs Tony D’Antonio, Thomas Thayer, and Reina Garcia adequately pleaded claims of invasion of privacy, intrusion upon seclusion, and unjust enrichment, Judge P. Casey Pitts of the US District Court for the Northern District of California said Tuesday.
