Slendertone Distribution LLC and California consumers alleging it tricked them into thinking its Flex Belt could give them well-defined abs without exercise have reached a fair and reasonable settlement, a California federal court said.
The agreement, which provides a $175,000 fund and label changes, was tentatively approved Tuesday by Judge Michael M. Anello of the U.S. District Court for the Southern District of California.
Jane Loomis alleged Slendertone’s advertisements suggesting that using its electrical muscle stimulator would assist in body contouring and could be used effectively as a replacement for abdominal exercises were false or misleading.
