Sixth Circuit Again Finds Horseracing Safety Law Constitutional

A federal horseracing anti-doping law is constitutional because the US government has the ultimate authority to make and enforce rules, the US Court of Appeals for the Sixth Circuit said Wednesday, weighing in on the law for the second time.

The Horseracing Integrity and Safety Authority, the private nonprofit that Congress authorized to help regulate the sport, is “subordinate to” the Federal Trade Commission, Chief Judge Jeffrey Sutton wrote in the unanimous decision.
