Sirius XM Prevails on Class Claims in Deceptive Royalty Fee Suit

Sirius XM Radio Inc. convinced a federal judge to strike class allegations from a lawsuit alleging the company failed to disclose a “Music Royalty Fee” that increases the price of its music plans by more than 20%.

The lead plaintiffs in the suit both signed up for their subscriptions through a phone call where they assented to a customer agreement that included a class action waiver, the US District Court for the Southern District of New York said Thursday. The court also granted the parties’ request to stay litigation for 60 days pending mediation.
