Simplot Wins Dismissal of Most Worker Wage Allegations, for Now

J.R. Simplot Co. is free for now of all but one claim in a wage-and-hour suit, although the worker who filed the would-be class case received permission to fix up the complaint and try again.

The agribusiness firm, known for fertilizer and frozen french fries, sought dismissal of the ex-employee’s state-law claims, with the exception of unpaid overtime accusations. The challenged allegations aren’t sufficient to move forward, but the US District Court for the Eastern District of California gave the worker 30 days to amend the complaint.
