Simplilearn Americas Inc. failed to convince a federal Massachusetts court to dismiss a proposed Video Privacy Protection Act class suit over its use of online trackers.
The digital skills learning service didn’t sufficiently show that the plaintiff, Justin Korn, had notice that he had agreed to bring legal disputes in federal court in Texas, and couldn’t persuade the US District Court for the District of Massachusetts that he fell outside the VPPA’s definition of consumer or that he insufficiently alleged Simplilearn knowingly disclosed his personal information.
