Radiology-services provider SimonMed Imaging LLC defeated a proposed class action alleging it negligently failed to protect the personal information of tens of thousands of people that was exposed in a February data breach.
The plaintiffs’ negligence claim failed because they didn’t show the medical-imaging company had a duty of care to protect them from the harms they suffered as a result of the data breach, Judge Steven P. Logan of the US District Court for the District of Arizona said Aug. 22.
