A Pompano Beach, Fla., nightclub, which said it was forced to close in part because of “excessive policing” linked to presenting concerts catering to Black audiences, failed to raise viable civil rights claims, the Eleventh Circuit affirmed Thursday.
The club failed to show its speech of musical expression was suppressed or that it was treated differently than other businesses, the U.S. Court of Appeals for the Eleventh Circuit said in an unpublished, per curiam opinion.
