Shopify Data Privacy Plaintiff Must Try Again After Dismissal

Shopify Inc. convinced a federal court to dismiss a proposed consumer data privacy class action because it failed to sufficiently allege Shopify intended to break the law or engaged in prohibited information collection practices.

Plaintiff Brandon Briskin failed to sufficiently plead that the user data collection a Shopify merchant disclosed in 2021 was also happening in June 2019, when he bought fitness apparel from a website. The complaint can’t go forward without additional details, Judge Phyllis J. Hamilton said for the US District Court for the Northern District of California.
