Shooting Victims Revive Deceptive Ad Claims Against Gun Makers

Victims of a 2022 school shooting in DC convinced a federal appeals court to reinstate their deceptive advertising claims alleging the makers of the shooter’s rifle intentionally marketed their products to adolescents who were attracted to violence.

The US Court of Appeals for the Fourth Circuit in a split ruling Wednesday said the shooting victims had standing to pursue their claims and remanded for further proceedings. The appeals court also vacated the portion of the lower court’s ruling stating the Protection of Lawful Commerce in Arms Act bars the suit.
