Sherwin-Williams Hidden Supply Chain Surcharge Suit Advances

A Sherwin-Williams Co. customer raised viable claims that the paint company deceived consumers by hiding a 4% “supply chain charge” that was tacked on after they made their purchases, a New York federal court said.

Maureen Dunham said Sherwin-Williams, like many companies, faced increased supply costs because of the Covid-19 pandemic.

But instead of raising its list prices in a transparent way, Sherwin-Williams chose to add the surcharge onto sales after customers had decided to buy items, she said in a proposed class suit in the US District Court for the Northern District of New York.
