Shelf Dividers Ruled Outside Flexible Magnet Duties’ Scope

A US retailer that imports magnetic plastic shelf dividers doesn’t need to pay fees on its products under antidumping and countervailing duty orders regulating raw flexible magnets imported from the People’s Republic of China, a federal appeals court said.

Fasteners for Retail Inc., which does business as Siffron, isn’t subject to the 2008 duty orders because its products contain inflexible magnets, the US Court of Appeals for the Federal Circuit said in a Tuesday opinion affirming a final scope ruling from the US Department of Commerce.
