Sheex Must Face Suit Over Spam Emails Creating False Urgency

Bedding and apparel company Sheex Inc. is stuck facing a proposed class suit alleging it sent spam marketing emails that created a false sense of urgency in violation of Washington state law, a federal judge ruled.

Plaintiff Andrew Devivo’s allegations that Sheex pressured customers for time with email subject lines like “Final Hours for BIG Sitewide Savings” and “No, Really—Last Chance to Shop Black Friday Savings!” were sufficient to claim a violation of the Washington Commercial Electronic Mail Act, Judge David G. Estudillo of the US District Court for the Western District of Washington said Tuesday.
