The EEOC must litigate in Pennsylvania rather than Maryland its lawsuit alleging Sheetz Inc. discriminates against job seekers based on race through the improper screening of applicants’ criminal justice histories.
Sheetz showed the convenience of witnesses favored transferring the case, the US District Court for the District of Maryland said. According to the company, the key witnesses are all employees of Sheetz Inc., Sheetz Distribution Services LLC, or CLI Transport LP who live and work in Pennsylvania, where Sheetz is headquartered, the court said.
