Sex Offender Loses Habeas Petition Over Registry, Ankle Monitor

A man convicted of sexually abusing his granddaughter can’t file a habeas petition to challenge his sex offender registration or his ankle monitor because his movement isn’t sufficiently restricted, the Sixth Circuit affirmed.

Frank Corridore filed his petition in Michigan federal court, arguing the “twin burdens” of his lifetime electronic monitoring and sex offender registration rendered him in custody.

Corridore’s restrictions, while intrusive, weren’t sufficiently custodial to validate his petition., the US Court of Appeals for the Sixth Circuit affirmed in a split decision on June 23.
