Seventh Circuit Gives Racial Discrimination Suit Another Shot

A lawsuit from a Wisconsin meat processing plant employee alleging discrimination was revived by a federal appeals court Friday.

Miko Thomas only had to allege that he suffered an injury to survive a motion to dismiss brought by his employer, JBS Green Bay Inc. He didn’t have to plead the degree of seriousness of the allegation, according to an opinion in the US Court of Appeals for the Seventh Circuit. Because Thomas sufficiently alleged discrimination under Title VII, the appellate court reversed and remanded his suit to district court.
