Sedgwick Disability Claims Rep Advances FLSA Overtime Suit

Sedgwick Claims Management Services couldn’t convince a federal judge in Tennessee to dismiss a proposed Fair Labor Standards Act collective action alleging the insurer misclassified claims representatives as exempt from overtime.

The company—which provides disability, workers’ compensation, and other types of insurance—argued that plaintiff Connie Gibb’s complaint was insufficient to support her claims because she didn’t specify exactly how many overtime hours she worked.

But FLSA overtime complaints don’t have to specifically allege “the approximate number of overtime hours” when they’re filed in courts covered by the U.S. Court of Appeals for the Sixth Circuit, Judge Samuel H. Mays Jr. ...
