The Second Circuit on Monday asked New York’s highest court to weigh in on state law preemption issues in a sexual assault against luxury real estate broker brothers Tal, Oren, and Alon Alexander.
The question of whether New York City law must cede to state law raises “important issues involving the structure of New York’s form of government, the relationship between New York State and its municipalities, and home rule principles reflected in the New York State Constitution,” said Judge Raymond J. Lohier Jr. of the US Court of Appeals for the Second Circuit.
