A toy company’s redesigned “Third-Generation” products are subject to an earlier preliminary injunction, the Second Circuit said in dismissing an appeal over a lower court’s ruling on the products.
Zuru Inc.'s second attempt at challenging the injunction order was rejected since circuit courts can’t address “appeals from orders that merely interpret or clarify the terms of an injunction,” the US Court of Appeals for the Second Circuit said in a Wednesday summary order dismissing the appeal for lack of jurisdiction.
