Second Circuit Hints at Punting on NYC Stun Gun Ban Dispute

Second Circuit judges signaled Wednesday there’s not enough evidence to analyze whether New York City’s ban on stun guns and tasers violates the Second Amendment.

The Second Amendment Foundation, Firearms Policy Coalition, and individual plaintiffs argue the ban denies citizens the right to opt for a non-lethal alternative to handguns for self defense, but the panel said there needs to be more evidence showing they’re in common use before a court can decide whether they qualify as an “arm” under the US Constitution.
