The National Football League will not get a second chance to convince the Second Circuit to dismiss a discrimination case brought against the league by former Miami Dolphins head coach Brian Flores.
The court on Monday rejected a request from the NFL, New York Giants, Houston Texans, and Denver Broncos for a rare en banc review of the case. A panel of judges in August ruled that Flores’ employment agreements, signed with various teams over the years, contain an “unenforceable” arbitration requirement that gives NFL Commissioner Roger Goodell final authority over arbitration disputes.
