Second Amendment Defense in Suppressor Indictment Falls Short

A man challenging his indictment for owning an unregistered firearm suppressor failed to show a federal appeals court that the National Firearms Act is unconstitutional or that a search of his home lacked probable cause.

George Peterson failed to show evidence that the NFA is used towards abusive means by charging exorbitant fees or subjecting applicants to lengthy processing times, Judge Jennifer Walker Elrod said. The US Court of Appeals for the Fifth Circuit affirmed the lower court’s decision to deny Peterson’s motion to dismiss the indictment and his motion to suppress evidence gathered at a search of his home. ...
