SeatGeek Kicks New York Fees Claims to Arbitration, Beats Class

SeatGeek Inc. can fight a group of customers in arbitration and can’t be subject to a class action lawsuit, a federal judge ruled in a partial win for the company facing deceptive fees litigation.

The group of concert and other event-goers sought to bring a class action complaint against SeatGeek alleging that fees added to the cost of tickets midway through the seat-selection and payment process violate New York’s ticket transparency law.

That question will have to be left to an arbitrator because most of the plaintiffs clicked agreement to SeatGeek’s online “Terms of Use” agreement, the court said. ...
