A federal judge ruled that Sears Holdings Corp.'s liquidating trust isn’t entitled to damages related to a $2.5 million bond posted by Mall of America, following the mall owner’s failed attempts to appeal a court order over ownership of the store’s lease.
The bond doesn’t insure against “every adverse consequence” of the winding litigation related to the three-story former Sears location in Minneapolis, Judge Colleen McMahon of the US District Court for the Southern District of New York wrote Tuesday.
