SCOTUSBlog Founder Goldstein Renews Fight Against Tax Charges

Tom Goldstein maintains that federal prosecutors are continuing to press allegations of tax evasion using spurious legal theories and haven’t properly informed him of all the charges against him.

The SCOTUSBlog founder filed several motions with the US District Court for the District of Maryland Wednesday to contest the tax charges and seeking to have several of them dismissed.

The flurry of court filings is the latest chapter in the criminal case that’s been heavily litigated since Goldstein’s indictment in January, including whether he violated the terms of his pre-trial release by transferring cryptocurrency.

Prosecutors maintain the prominent appellate attorney failed to report or mischaracterized millions in gambling debt and created fake jobs for women with whom he was, or hoped to become, romantically involved. Goldstein denies the charges.

His latest set of filings comes as the government pushed back on his prior efforts to challenge the tax charges, which prosecutors called meritless.

Goldstein’s motions include one to dismiss allegations of tax evasion outlined in the government’s indictment because they don’t allege an affirmative act.

He also moved to dismiss as time-barred several other counts of tax evasion, willful failure to pay taxes, and aiding and assisting in the preparation of false or fraudulent tax returns, while saying others were reliant on shaky legal theories.

Goldstein also moved to suppress some statements he made during questioning, arguing he should have received Fifth Amendment warnings and that the government was mischaracterizing the nature of its questioning.

Additionally, he sought to compel disclosure of some materials, including legal instructions to the grand jury, and motioned for a bill of particulars.
