Schwan’s Consumer Brands succeeded in getting a class action dismissed that alleged the food company misled consumers about the butter content of a Dutch Apple Pie product.
Mrs. Smith’s Original Flaky Crust Dutch Apple Pie does have butter; its crust has a shortening butter blend that has more palm oil than butter. But Yonnette Davis alleged that because the packaging of the pie said it was “‘Made with Real Butter,’” she believed “butter was the predominant or exclusive shortening in the pie crusts,” according to the opinion from the US District Court for the Southern District of New York.
