School Must Face Bias Suit by Student Who Classmates Called Gay

A Boston school must face a discrimination suit brought by a student who was allegedly harassed by classmates who thought he was either gay or transgender, the First Circuit said.

The district court granted the Brooke Charter School East Boston summary judgment on MG’s claim under Title IX of the 1972 Education Amendments. But the Thursday opinion by Judge Gustavo A. Gelpí of the US Court of Appeals for the First Circuit said that, based on the record, a reasonable jury could conclude that the school didn’t adequately address the harassment MG endured, reversing the lower court’s ruling.
