School District’s Trans Bullying Rules Split Sixth Circuit (1)

An Ohio school district’s policies prohibiting bullying by misgendering students likely violates the First Amendment, the full Sixth Circuit said Thursday in an ideologically-split ruling.

The US Supreme Court made clear that school policies can’t restrict speech on major issues unless it’d cause a disruption or infringe on the rights of others, the US Court of Appeals for the Sixth Circuit said in its en banc ruling.
