Schlumberger Technology Corp. won a new shot at arguing a former worker’s role was exempt from federal overtime requirements after the Tenth Circuit ruled that was a question for a judge, not a jury.
The trial court shouldn’t have allowed a jury to decide the legal question of whether the ex-employee’s salary made him exempt from the Fair Labor Standards Act’s overtime protections, the US Court of Appeals for the Tenth Circuit said, tossing the verdict that awarded the worker more than $39,000 in overtime back pay.
