While plaintiff Samantha Moser adequately stated the elements of her negligence claim, her remaining claims had a variety of pleading failures and the claims of Moser’s co-plaintiffs and of her minor children lacked standing, Judge Robert F. Rossiter Jr. of the US District Court for the District of Nebraska said Monday.
