Sanofi Subsidiary Drug Shortage Suit Revived by First Circuit

A subsidiary of biotechnology-giant Sanofi SA must face the latest lawsuit from a group of patients with a rare genetic disorder, the First Circuit said Thursday.

A group of Fabry disease patients—who lack the enzymes to break down fats—allege that Genzyme’s decision to ration its drug during a shortage caused them harm, including allergic reactions or an acceleration of their disease.

While patients couldn’t convince the First Circuit of their standing in 2016, their recent argument compelled the justices to let some of their claims move forward.
