Sanofi Can’t Shed Taxotere Eye Injury Litigation on Preemption

Sanofi-Aventis US LLC failed to convince a federal judge that claims alleging its chemotherapy drug Taxotere caused eye injuries were preempted by federal law.

The Federal Food, Drug and Cosmetics Act allows drug manufacturers to strengthen their warning labels when they get new information about side effects and risks through data not previously submitted to the Food and Drug Administration.

The US District Court for the Eastern District of Louisiana said Monday that the record contained evidence that Sanofi had the kind of newly acquired information that would allow it to change its label as early as 2003.
