San Francisco Nurses Lose Overtime Case Due to Past Sanctions

San Francisco nurses lack enough evidence to overcome final judgment in their overtime lawsuit against the city after some of them were sanctioned, which fatally hindered their ability to engage in discovery.

The nurses are disqualified for overtime protections under the Fair Labor Standards Act since they’re unable to offer any evidence establishing the city denied them the opportunity to work their scheduled hours, Judge Richard Seeborg ruled Monday. The city’s motion for summary judgment was granted and the suit was dismissed from the US District Court for the Northern District of California.
