Sam’s Club Manager Ducked Racist Incident, Lacks Age Bias Claim

A former Sam’s East Inc. manager in Ohio lacks triable evidence that his termination at age 52 and replacement with a 26-year-old was age bias, not the result of mishandling a racist incident at his store, a federal judge in Dayton ruled.

Robert Duncan pointed to his former supervisor, who he said had previously asked him if he felt the business was passing him by and commented that some older assistant managers weren’t adapting. Duncan argued he didn’t receive lesser discipline for the incident because of her.
