Rule on Guns, Stabilizing Braces Remains in Effect During Suit

The Bureau of Alcohol, Tobacco, Firearms, and Explosives’ new regulation that treats handguns with attached stabilizing braces as short-barreled rifles, subject to stricter regulation under federal gun laws, shouldn’t be preliminarily enjoined, a federal court said.

The ATF’s adoption of the new rule that took effect this year didn’t violate the Administrative Procedure Act, the opinion by Judge Daniel L. Hovland of the US District Court for the District of North Dakota said Tuesday.
